End User License Agreement (EULA)
for Mortian Online Alpha

1. General Terms
   This End User License Agreement (“Agreement”) governs the use of the software Mortian Online Alpha (“Game”) provided by Mortian UG (haftungsbeschränkt) (“Provider”). By installing, accessing, or using the Game, the user (“Player”) agrees to be bound by the terms of this Agreement. If the Player does not agree, they must not install or use the Game.
2. Testing Phase
   The Game is currently in a closed testing phase (“Closed Alpha”). Access is provided exclusively through invitations or authorizations issued by the Provider. The Game, including all features, content, and data, is under active development and may be modified, suspended, or removed at any time without prior notice.
3. Ownership and License
   All intellectual property rights in and to the Game, including but not limited to software, source code, graphics, text, and design elements, are owned by the Provider. The Player is granted a limited, non-exclusive, non-transferable, revocable license to use the Game solely for testing and evaluation purposes. No ownership rights are transferred.
4. Player Conduct
   The Player agrees not to:

• circumvent, disable, or tamper with any security features or access restrictions;
  
  
• exploit bugs, glitches, or vulnerabilities;
  
  
• share, distribute, or publicly disclose any part of the Game or related materials without written permission;
  
  
• use the Game for any commercial purpose;
  
  
• engage in behavior that disrupts testing or other players’ experiences.
  
  

5. Disclaimer of Warranty
   The Game is provided “as is” and “as available.” The Provider makes no warranties, express or implied, regarding the Game’s performance, reliability, or fitness for a particular purpose. Participation in testing is at the Player’s own risk.
6. Limitation of Liability
   To the fullest extent permitted by law, the Provider shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Game, except in cases of intent or gross negligence.
7. Data Protection
   During the testing phase, certain usage data and crash reports may be collected for development and debugging purposes. Servers are located within the European Union, primarily in Germany. Personal data will not be shared with third parties without explicit consent and will be processed in compliance with applicable data protection laws (including the GDPR).
8. Term and Termination
   This Agreement remains effective for the duration of the Closed Alpha testing phase. The Provider may suspend or revoke access at any time, with or without cause, and without prior notice.
9. Modifications
   The Provider reserves the right to update or modify this Agreement at any time. Continued participation in the testing phase constitutes acceptance of the revised terms.
10. Governing Law and Jurisdiction
    This Agreement is governed by the laws of the Federal Republic of Germany. Where legally permissible, the exclusive place of jurisdiction shall be the registered seat of Mortian UG (haftungsbeschränkt).
